Terms and Conditions of Retiro Running Services

The following terms and conditions establish a contract between the user and Retiro Running. This contract is considered accepted by the user when attending any of the events, being a member of the group through any of the applications (Meetup or Strava), paying for the services, or being present on a platform that identifies the Retiro Running brand in Madrid (Spain). It is important for the user to carefully read this contract before participating in any event or using any service offered by Retiro Running. By accepting these terms and conditions, the user agrees to comply with all policies and rules established by Retiro Running.

A. INTRODUCTION TO OUR SERVICES

The purpose of this contract is to enable participation in Retiro Running events, including monthly Running activities, which are defined as outdoor continuous running, as well as Meet&Chill social activities and integration of the community through the exclusive WhatsApp group. Through our services, users can purchase and subscribe to monthly plans and are protected by applicable consumer legislation.

Our services are available exclusively within or outside El Retiro Park in Madrid, Spain, as well as other social events in the Community of Madrid or in your country of residence, or in any other EU member state where you are temporarily located. By joining the Retiro Running group through Meetup or Strava, you establish your country of residence. To use our services, it is necessary to have running tools and equipment (professional running gear is recommended and often required), a mobile device to join events through the applications and/or GPS, and internet access, subject to any applicable charges by the respective provider. It should be noted that the performance of our services may be affected by these factors.

B. USE OF OUR SERVICES: Payments and Refunds

At Retiro Running, we offer different payment options for our services. Events can be attended for free during the first two weeks, exclusively for new members, or through payment once the trial period is over, either for individual events or through subscriptions. Each transaction you make with us will be considered an electronic contract between you and Retiro Running, and/or with the entity responsible for providing the service in which we publish our content.

The prices of our events, including individual prices, packages, offers, and subscriptions, may be subject to changes at any time, so we recommend reviewing them frequently.

We offer various payment methods for your convenience and security: Cash, Paypal, Revolut, Bizum, Bank Transfer, and debit and credit cards, both local and international, such as Visa, Visa Pay, Mastercard, Maestro, American Express, Diners Club, Discover, Union Pay, Google Pay, and Apple Pay. You may also receive a payment link via SMS or email using QR technology.

If for any reason we are unable to charge your primary payment method, such as an expired card or insufficient funds, Retiro Running reserves the right to charge any of the other selected payment methods, following a predetermined order. If payment still cannot be processed, we will contact you to attempt to resolve the situation, although you will remain responsible for any outstanding amounts.

If there is an issue with the payment, the organizer on behalf of Retiro Running has the discretion to postpone the payment or withhold the service until the corresponding payment is made. In any case, we will be available to resolve any inconvenience that may arise.

Customers may request to receive all invoices in electronic format, via email or another designated method. Prices for services may be modified at any time by Retiro Running. In the event that an activity cannot be carried out or is unreasonably delayed due to internal issues, Retiro Running may, as the sole remedy, reschedule the activity for a later date, if possible, or provide a refund of the amount paid.

Retiro Running reserves the right to suspend, cancel payment, or reject a refund request if there is evidence that the request is fraudulent, abusive, illegal, or any other manipulative behavior that justifies Retiro Running's counterclaim.

Non-premium members may join any event once the corresponding transaction has been completed. Premium members will have access to Retiro Running services for one (1) month from the transaction date. It is not possible to extend the duration of this service due to lack of attendance or other personal or external factors. Members are responsible for attending scheduled events.

Both Premium and Non-premium members must complete the corresponding transaction before the event in person unless an alternative payment method, such as prepayment through links or via the website, has been agreed upon.

Right of withdrawal (for Retiro Running services): If the customer decides to cancel their order, they can do so within 14 days after receiving the receipt, without the need to indicate a reason. However, the days on which the customer has been present will be charged, or a prorated refund will be issued. There will be no full refund for a service already provided to the member. This clause only applies to purchases made in advance of the service and is not valid for purchases made at the time of service provision.

To meet the withdrawal deadline, the customer must send their cancellation notice before the 14-day period expires.

To cancel an order, the customer must inform Retiro Running of their decision through established communication channels, such as mobile applications (Meetup, Whatsapp, and Instagram).

In the case of cancellation, a refund will be issued within 1 to 14 days from the day of receiving the withdrawal notice. The same payment method used for the original transaction will be used for the refund. If this is not feasible, the most convenient method for both the organizer and the customer will be utilized.

Exception to the right of withdrawal: The customer cannot cancel their order if the service has already commenced once the customer has requested it and accepted that by doing so, they will lose their right of withdrawal.

Regarding goods, the right of withdrawal cannot be exercised if the items have been personalized, sealed, and/or are not suitable for return due to health and hygiene reasons, or if they have been unsealed after delivery. Additionally, if the product has been damaged due to customer misuse, Retiro Running is not liable, and a refund will not be issued.

This form should be completed and sent to Retiro Running via email at info@retirorunning.com to exercise your right of withdrawal within 14 days from the receipt of the receipt. The consumer will be responsible for paying for the days they have used the services, or they may request a prorated refund, without a full refund being provided for a service already provided. The refund will be made using the same payment method used for the transaction, unless an alternative method is agreed upon. The consumer cannot exercise their right of withdrawal once the service has commenced after it has been requested and accepted, and it will be considered that they have lost their right of withdrawal.

PRICES

The prices of Retiro Running events and products, including attendance to individual or monthly events, premium annual membership, offers, individual or premium packages, merchandise, accessories, and other services, will be reflected on the communication channels, websites, or displayed in person during the transaction process. Authorized organizers of Retiro Running have the right to change these prices at any time, with prior notification. The use or alteration of prices without authorization from Retiro Running management is prohibited.

ACCOUNT, MEMBERSHIP, AND PRIVACY

To access Retiro Running services and attend their events, it may be necessary to create a Meetup account. A Meetup account is the account used by all Retiro Running members to register for events through electronic devices. The use of the Retiro Running group on Meetup is subject to this agreement and also requires a Meetup account. Your account is valuable, and you will be responsible for preserving its confidentiality and security. Retiro Running will not be responsible for any losses resulting from unauthorized use of your Meetup account. Please contact the Retiro Running organizer if you suspect that the confidentiality of your Meetup account has been compromised.

You must be 18 years of age or older (or the equivalent minimum age in your country of residence, as indicated in the Meetup app account creation process) to create a Meetup account and use our services. Meetup accounts for individuals below the age mentioned above can be created by their parent, legal guardian, or an approved educational institution using the "Family" feature. The parent, legal guardian, or individual creating the account for a minor must review this agreement with the minor to ensure that both the minor and the parent, legal guardian, or individual creating the account understand the activities of Retiro Running.

CONSENT FOR THE USE OF AUDIOVISUAL CONTENT

As a member of Retiro Running, whether through mobile applications, social media, or attending in-person events, you agree to the use and commercialization of audiovisual recordings by Retiro Running, including photographs, videos, images, prints, clothing, accessories, and their use for advertising on any media platform. If you do not agree with this, you must reach an agreement with the organizer, and you will only be able to edit the advertising content if the campaign has not yet been launched. If the campaign is already underway, the content cannot be changed until its completion.

As a member of Retiro Running, you agree to the following conditions for all audiovisual and marketing content used in Retiro Running events:

You understand that the event will be recorded, and you agree that Retiro Running may distribute the recorded content for promotional purposes. By making the first payment, joining the Meetup group, the Strava group, or the WhatsApp community, you are giving your consent to be recorded and for Retiro Running to use the content for promotional purposes, including voice, image, lighting, and video, for any publication made on behalf of Retiro Running. Upon leaving the group, you consent to Retiro Running retaining past publications in which you were present, and you will not be able to claim or report any photos or videos (audiovisual content) in which you previously appeared. If you are a member of the group and do not agree to be recorded, it is necessary to communicate this in advance to the organizer or any staff member to avoid recording or photography. Otherwise, you will be accepting the conditions outlined in the "Audiovisual Content" section. It is important to note that Retiro Running reserves the right to delete or modify any audiovisual content in which you appear if there are any claims or complaints from your side.

USAGE RULES

By using the services of Retiro Running, you agree to comply with the following usage rules:

1. Exclusive personal use: The services can only be used for personal and non-commercial purposes unless expressly permitted by Retiro Running or stated otherwise in the specific terms and conditions of the service.

2. Intellectual property rights: The provision of services by Retiro Running does not grant any right to use them for commercial or promotional purposes, nor does it constitute a waiver or grant of any intellectual property rights.

3. Attendance at events: Access to Retiro Running events is subject to availability. If there is insufficient capacity, Retiro Running reserves the right to remove the member from the event. In the event of event cancellation, extension, or removal, no claims or complaints will be accepted from the member.

4. Manipulation of ratings or reviews: Manipulating the ratings or reviews of Retiro Running services through any means, including bots, scripts, or automated processes, is strictly prohibited. Furthermore, providing or accepting any form of compensation or incentive to manipulate ratings or reviews is prohibited.

5. Responsibility for belongings: The member is responsible for their belongings at all times during Retiro Running events.

6. Health responsibility: You are responsible for your own health. It is necessary that you know your physical condition before participating in any event. By registering for our events, you inform both the organizers of Retiro Running and its members that you are capable of exercising ("Running") without any health issues. Otherwise, if this leads to injuries or harm, Retiro Running is not liable for such incidents.

7. Event liability: You are responsible for theft, robbery, assault, minor or major injuries, murder, external damage to the park, accidents caused by other group members, accidents caused by external factors, weather conditions, or supernatural events. Retiro Running, organizers, staff members, co-organizers, editors, or any other member will not be held responsible for incidents that occur during and outside of Retiro Running events.

8. Misuse of the Retiro Running brand: Unauthorized use of the Retiro Running brand for plagiarism or activities carried out in its name without authorization from the organizers and/or misleading members is strictly prohibited. This will result in immediate expulsion and legal action.

9. Access to our services: You can only access our services by using the Meetup app to register for events. If you do not use it, Retiro Running will not be held responsible if the event reaches full capacity, and you will not be able to attend the event without the right to claim or report.

10. Sale of audiovisual content or marketing material: Generally, purchased content or materials will be delivered to the member according to the available timelines set by Retiro Running. Timelines may vary due to production and shipping processes.

11. Premium services: Premium members will have priority in receiving information for the next Meet&Chill event. These members will have to confirm their attendance "in full" (please refer to the following regulations) to pass the communication to non-premium members. Premium members will have a 24-48 hour timeframe from being notified to confirm their attendance at the event. If a member needs more time, Retiro Running is not responsible if the capacity is filled by other premium or non-premium members.

12. Respect for others: You are responsible and aware that it is strictly prohibited to harass, insult, harm, or cause any intentional or accidental damage, whether it be verbal, physical, or psychological violence, that affects any member, participant, organizer, staff, team, or the environment of Retiro Running, animals, or any living being, whether in any means of communication or in-person. Failure to comply with this rule will lead to consequences.

Retiro Running reserves the right to monitor the member's use of the services to ensure compliance with these usage rules. Any use of the services contrary to these terms and conditions will be considered a serious breach of this agreement.

 

MEET & CHILL

Retiro Running and authorized organizers reserve the right to adjust, modify, change the schedule, eliminate, choose the location, choose the type of event, cancel, and make any modifications involving the event with its "Premium" and/or "non-premium" members without refund or partial or full refunds.

Retiro Running is not responsible if a "Meet&Chill" event is canceled due to internal or external factors, such as internal staff issues, lack of capacity, lack of resources such as money, venue space, time, or external factors such as weather, wars, disasters, park closures, park destruction, prohibitions by the Madrid City Council or the Spanish government and its authorities.

Retiro Running is not responsible if the capacity is full and it has to deny access to a "Premium" member who confirmed attendance outside the required timeframe. Please refer to the confirmation timeframe in the "Terms of Service".

The payment for this service only includes your access. The costs of food, reservation, entry, games, drinks, or any other consumption made at the venue are separate and sold independently by the venue or location where the event is planned.

By using the Meet&Chill services of Retiro Running, you fully accept and understand these terms and conditions. Any violation of these terms and conditions may result in denial of access or expulsion from the event without refund or reimbursement.

RETIRO RUNNING EVENTS - RUNNING TUESDAY- THURSDAY- SUNDAY - (AND OTHER DAYS).

Please carefully read these Terms and Conditions before using the services of Retiro Running. By using Retiro Running's services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use Retiro Running's services.

Modifications and Event Cancellations Retiro Running and all authorized organizers reserve the right to make any modifications involving the event with its "Premium" and/or "non-Premium" members, including but not limited to adjusting, modifying, changing the schedule, eliminating, choosing the location, choosing the type of event, canceling, and making any modifications without prior notice, without refund, and/or without full or partial reimbursements.

Liability Retiro Running is not responsible if a running event is canceled due to internal or external factors, such as internal staff issues, lack of capacity, lack of resources such as money, venue space, time, or external factors (weather, wars, disasters, park closures, park destruction, prohibitions by the Madrid City Council or the Spanish government).

Retiro Running is not responsible if the capacity is full and has to deny access to a "Premium" or "non-Premium" member for confirming attendance outside the required timeframe. (Refer to the confirmation timeframe in the "Terms of Service").

CUSTOMER SUPPORT

If you have any questions about our services, such as billing, prices, or your Meetup account, please email us at info@retirorunning.com, where you can contact us by selecting the most relevant subject for you in the "subject" field. If you choose to chat with us, you have the option to do so through applications such as Whatsapp, Meetup, Instagram, Tiktok, Facebook, or Strava.

We will provide general support for all services, which includes the following: Retiro Running will provide assistance for any transaction-related matters, including but not limited to payment, delivery, and refunds; for any matters related to the service of Retiro Running events.

 

C. SUBMISSION OF MATERIALS TO OUR SERVICES

Our services may allow you to submit materials such as comments, ratings, reviews, photographs, videos, and podcasts (including associated metadata and graphics). To use these features, you must comply with the following submission guidelines, which may be updated from time to time. If we become aware of materials that violate these guidelines, we will remove them. If you come across materials that do not comply with the submission guidelines, please contact us via email to report the issue.

Unless prohibited by applicable law, you grant Retiro Running a worldwide, royalty-free, non-exclusive license to use the materials you submit within the services and for marketing activities related to them, as well as to use the materials you have submitted for internal purposes of Retiro Running. Retiro Running may monitor, remove, or edit any materials you have submitted. Retiro Running does not control or verify whether you have used a service or consumed any content before submitting a comment, rating, or review about such service or content.

Submission Guidelines: You may not use the services to:

Post materials (i) that you do not have the right to use or for which you do not have the necessary authorization or license, or (ii) that infringe the rights of any third party. Post questionable, offensive, illegal, misleading, incorrect, or harmful content. Post personal data or private or confidential information belonging to third parties. Solicit personal data from a minor. Impersonate another person or entity or falsely state that you are affiliated with another person or entity. Post or transmit spam, including, among others, unsolicited or unauthorized advertising, promotional materials, or informational announcements. Post, modify, or remove a rating or review in exchange for any form of compensation or incentive. Post dishonest, abusive, harmful, misleading, or bad faith ratings or reviews, or ratings or reviews that are irrelevant to the content being commented on. Plan or engage in any illegal, fraudulent, or manipulative activity. These submission guidelines are designed to ensure that our services are used responsibly and respectfully towards the rights of third parties. By submitting materials to our services, you agree to these guidelines and commit to comply with them at all times. Retiro Running reserves the right to take action against any user who violates these guidelines, including the removal of materials and the cancellation of the user's account.

 

MODIFICATIONS TO THE AGREEMENT:

Retiro Running reserves the right to modify this contract and establish new terms or conditions at any time and for any reason. These modifications and additional terms and conditions will be promptly communicated to the user, and if accepted, they will take effect immediately and become an integral part of this contract. If the user does not accept the modifications, Retiro Running will have the right to terminate this contract, and/or the user will no longer be able to make any further purchases related to any service or content governed by this contract. However, this will not affect any content that the user has already acquired or downloaded.

BELONGINGS:

Retiro Running shall not be responsible for the belongings of third parties, including former members, non-members, or Retiro Running members. Neither the loss nor the damage of any material, whether physical or digital, from any person or company.

INTELLECTUAL PROPERTY:

The user acknowledges that the services, including, among others, the content, graphics, audio clips, video clips, and editorial content, contain information and materials protected by proprietary rights belonging to Retiro Running, its licensors, and/or its content providers. These services and materials are protected by applicable intellectual property laws and other laws, including copyright laws.

The user agrees not to use in any way such information or materials protected by proprietary rights, except in relation to the use of the services for personal and commercial purposes in accordance with this contract. No part of the services or the content may be transferred, except to the extent expressly permitted by this contract. The user agrees not to rent, lease, or loan the services or the content in any way, and will not exploit the services in any unauthorized manner.

The name Retiro Running, the Retiro Running logo, Meet&Chill, and other Retiro Running trademarks, service marks, graphics, and logos used in connection with the services are trademarks or registered trademarks of Retiro Running in Spain. The user is not granted any rights or licenses with respect to any of the mentioned trademarks or any member of the community, excluding the brand founder.

 

PENALTIES

In the event of inappropriate use of the regulations, Retiro Running reserves the right, under the authority granted to its staff and organizers, to temporarily or permanently expel, penalize, or adjust any member, without the right to refund or any partial or full reimbursement of services.

"Premium" and "non-premium" members have the right to vote to expel or reinstate a member if deemed necessary, with the vote of the person being judged not counting towards the results. For a decision to be valid, it requires the approval of more than half of the active members of Retiro Running. If this quorum is not achieved, the decision for temporary or permanent expulsion will rest with the organizers/founder of Retiro Running. The only person exempt from this procedure is the founder of Retiro Running.

It is strictly prohibited to reintegrate a former expelled member of Retiro Running through economic agreements or other fraudulent, immoral, or unethical practices.

TERMINATION AND SUSPENSION OF SERVICES

If you breach any provisions of this contract, Retiro Running reserves the right to terminate this contract and/or expel you from the Retiro Running community. In the event of termination or cancellation, the member will remain responsible for payment of all amounts owed under their Retiro Running account or membership up to the date of termination and/or cancellation.

Furthermore, Retiro Running reserves the right to modify, suspend, or discontinue the services (or any part or content thereof) at any time for technical or operational reasons. In such cases, Retiro Running will not be liable to you or any third party.

 

EXCLUSION OF WARRANTIES; LIMITED LIABILITY

a. Retiro Running will provide the Services with a reasonable level of professionalism and diligence. Subject to local legislation, you have a legal warranty of conformity for the services purchased for a duration determined by the service plan and for the materials you have subscribed to during the contractual period established for the provision of the service. Retiro Running makes no other promises or warranties regarding the services, and in particular, does not guarantee that, beyond the legal warranty: (i) the use of the service will be uninterrupted or error-free. You acknowledge that Retiro Running may occasionally, for technical or operational reasons, remove the service for indefinite periods of time or cancel the services at any time for technical or operational reasons, and you will be notified to the extent possible. If Retiro Running interrupts a service that is exclusively and solely a paid subscription by you, you will be refunded only for the services not performed. If Retiro Running interrupts a service that does not constitute a subscription, it will not affect the content/material or service that you have already acquired. (ii) the services will be free from losses, corruption, attacks, interference, plagiarism, or other security intrusions that constitute force majeure, and Retiro Running disclaims all liability in this regard. You are responsible for attending events, including any material purchased or acquired through the service.

b. UNLESS REQUIRED BY APPLICABLE LAW, YOU AGREE THAT RETIRO RUNNING SHALL HAVE NO LIABILITY TO CONTINUE PROVIDING THE RETIRO RUNNING SERVICES THROUGH DIFFERENT THIRD-PARTY APPLICATIONS. RETIRO RUNNING STAFF MEMBERS, DIRECTORS, AND ORGANIZERS SHALL NOT BE LIABLE TO YOU IF MERCHANDISING OR SERVICES CEASE TO BE AVAILABLE FOR USE.

c. Except as set forth in section (e) below, or in the event that you are exercising any applicable legal rights for refund or compensation, under no circumstances shall Retiro Running, its directors, officers, employees, affiliates, agents, contractors, or licensors be liable for any loss or damage caused by Retiro Running, its employees, or agents, where: (i) there has been no breach of a legal duty of care owed to you by Retiro Running or any of its employees or agents; (ii) it is not a reasonably foreseeable result of such breach; (iii) any increase in the loss or damage results from your breach of any term of this contract; (iv) it results from a decision by Retiro Running to remove or deny access, to refuse to process any information, to warn you, or to suspend or cancel your access to the Service.

e. Nothing in this contract shall limit or exclude Retiro Running's liability for fraud, gross negligence, willful misconduct, or for death or personal injury caused by Retiro Running's negligence.

f. In the event of your breach of the terms and conditions of this contract, you shall be liable to Retiro Running, its directors, organizers, employees, affiliates, contractors, and licensors for any claim arising from such breach. You shall also be liable for any action that Retiro Running takes as part of its investigation of an alleged violation of this contract, or as a result of its findings or decision that a violation of this contract has occurred.

g. Retiro Running shall not be responsible for any mobile data expenses you may incur in connection with the use of the services.

In summary, this contract establishes that Retiro Running will provide the services with a reasonable level of professionalism and diligence but does not guarantee uninterrupted or error-free use of the service. Retiro Running shall not be liable for losses, corruption, attacks, interference, plagiarism, or other security intrusions that constitute force majeure. The contract also states that Retiro Running shall not be liable for the use of the services through different third-party applications. However, Retiro Running will make reasonable efforts to protect the information submitted by you in connection with the services. Additionally, the contract states that Retiro Running shall not be liable for loss of revenue, business, or profits, or any loss or corruption of data in connection with the use of the services. You will be responsible for any breach of the terms and conditions of this contract and liable for any claims arising from such breach. This contract also states that Retiro Running shall not be liable for any mobile data expenses you may incur in connection with the use of the services. In the case of fraud, gross negligence, willful misconduct, or death or personal injury, Retiro Running will not limit its liability.

It's important to carefully review the complete terms and conditions of the contract to fully understand your rights and obligations as a user of Retiro Running's services.

 

EXCEPTIONS FOR PUBLIC INSTITUTIONS

In the event that any provision of this contract is deemed invalid or unenforceable for the Client in accordance with applicable local, national, state, or federal laws, such provision shall be deemed invalid or unenforceable and shall be interpreted in a manner that is most consistent with applicable law.

APPLICABLE LAW

Except to the extent expressly permitted in the following paragraph or as required by applicable law, this contract, the relationship between the Client and the Company, and all transactions conducted through the services shall be governed by the laws of the Community of Madrid, without reference to its rules on conflicts of laws. The Client and the Company submit to the exclusive jurisdiction of the courts of the Community of Madrid to resolve any dispute or claim arising from this contract.

If the Client does not meet any of the following conditions: (a) not being a Spanish citizen; (b) not residing in Spain; (c) not accessing the Service from Spain; and (d) being a citizen of any of the countries identified below, the Client agrees that any dispute or claim arising from this contract shall be subject to the applicable law specified below, without reference to any rules on conflicts of laws, and irrevocably submits to the non-exclusive jurisdiction of the courts corresponding to the following state, province, or country, whose laws shall apply:

If you reside in any country in the Americas or in the United Kingdom, Switzerland, Norway, or Iceland, the applicable law and jurisdiction shall be determined by your habitual residence.

The United Nations Convention on Contracts for the International Sale of Goods is expressly excluded from this contract.

 

ADDITIONAL PROVISIONS

This contract represents the entire agreement between the user and Retiro Running regarding the use of the services and supersedes any prior agreements between the parties relating to the same subject matter. Additionally, this contract may be subject to additional terms and conditions that apply when the user engages in transactions or uses associated services, third-party content or software, or additional services such as the volume purchasing program.

In the event that any provision of this contract is declared invalid or unenforceable, such provision shall be interpreted in accordance with the applicable law to the fullest extent possible, and the remaining provisions shall remain in full force and effect. The failure of Retiro Running to exercise any right or enforce any provision of this contract shall not constitute a waiver of such right or provision.

The user agrees to comply with all applicable local, state, federal, and national laws, regulations, ordinances, and rules in connection with their use of the services. The use of the services may also be subject to other laws. The risk of loss for all electronically conducted transactions shall pass to the buyer upon transmission to the recipient by electronic means.

No employee or agent of Retiro Running has the authority to modify this contract.

Retiro Running may send notifications regarding the services via email to the user's email address or by postal mail to their address, or by posting the notifications within the services themselves. Notifications shall be effective immediately. Retiro Running may also contact the user via email or push notifications to provide additional information about the services.

The user grants Retiro Running the right to take all actions that Retiro Running reasonably deems necessary or appropriate to enforce and/or verify compliance with any provision of this contract. The user acknowledges that Retiro Running shall have the right, without any liability to them, to disclose any data and/or information to law enforcement authorities, public officials, and/or third parties if Retiro Running reasonably deems it necessary or appropriate to enforce and/or verify compliance with any provision of this contract (including, among others, Retiro Running's right to cooperate in any legal proceedings related to the user's use of the services and/or material, and/or a third-party claim that the user's use of the services and/or content is illegal and/or infringes upon the rights of such third party).
